Funds4Schools is operated by Funds4 Limited, The Old Forge, 3 Packman Lane, Kirk Ella, Hull HU10 7TH.

By participating in the Funds4Schools Program and / or using the Funds4Schools.co.uk website, you signify your assent to these terms and conditions. If you do not agree to these terms and conditions, please do not participate in the Funds4Schools Program or use the Funds4Schools.co.uk Site. We reserve the right, at our discretion, to change, modify, add to or remove portions of these terms and conditions at any time. You agree to receive notification of modifications to this Agreement via the Funds4Schools.co.uk site. If you continue to use the Funds4Schools.co.uk Site and/or participate in the Funds4Schools Program following the posting of any changes to these terms and conditions, your continued use or participation will mean you accept these changes and agree to be bound by the new terms. Please check these terms and conditions periodically for changes. You can review the most current version of the terms and conditions at any time by clicking here.

Funds4Schools operates various fundraising opportunities for schools and non-profit youth organizations: (1) Funds4Schools Online shopping; (2) Funds4Schools Online Store (3) Funds4Schools ISP Services, which together, shall be referred to herein as "The Funds4Schools Program." The Funds4Schools Program is described in more detail below.

Funds4Schools Online shopping
Funds4Schools operates interactive online shopping ("Funds4Schools Online Shopping") that enables Funds4Schools's users ("Users") to access the web sites of third party merchants ("Merchants") and to purchase certain goods or services from such Merchants' web sites. Funds4Schools Online Shopping enables users to direct rebates, which are generated by their purchases and are based on referral fees paid by the Merchants, to one of Funds4Schools's enrolled schools. The amount of the rebate will be in accordance with Funds4Schools's policy in effect at the time a purchase is made. User must designate an enrolled school to receive rebates generated by the User's purchases prior to making any such purchases; otherwise, the rebates will not be credited to the enrolled school.

Where a SCHOOL is inactive with Funds4Schools but earns rebates from purchases made by consumers, the SCHOOL will become an active school by cashing the cheque issued by funds4schools.co.uk. Active SCHOOL is defined as a school who has registered with Funds4Schools via fax, phone, or mail, assigns a volunteer to promote the program to their supporters, and agrees to the terms of said License Agreement.

To generate a rebate, a User must follow a link on the Funds4Schools.co.uk Site to the Merchant site, make a purchase, accept delivery and make payment for the purchase to the Merchant. The amount of rebates payable vary depending on the Merchant and depending on the item or service purchased. Rebates may be subject to adjustment in the event of returns by the User and subject to other terms and conditions between Funds4Schools and the Merchant. The rebates will be in accordance with the rebate percentages listed on the Funds4Schools.co.uk site at the time of the User's purchase and be subject to the deduction of VAT.

Restrictions
User is not authorized to make any representations or warranties to an enrolled school regarding the rebates or the Funds4Schools Program. The rebates are made by Funds4Schools.

Limitations
User understands that Funds4Schools does not operate or control the products or services offered by Merchants. Merchants are responsible for all aspects of order processing, fulfilment, billing and customer service. Funds4Schools is not a party to the transactions entered into between Users and Merchants. USER AGREES THAT PARTICIPATION IN THE FUNDS4SCHOOLS PROGRAM IS AT THE SOLE RISK OF USER AND THAT THE FUNDS4SCHOOLS PROGRAM IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF TITLE, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY OR NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES SHALL FUNDS4SCHOOLS OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES ARISING FROM THE TRANSACTIONS BETWEEN USERS AND MERCHANTS OR FOR ANY INFORMATION APPEARING ON MERCHANT SITES OR ANY OTHER SITE LINKED TO THE FUNDS4SCHOOLS.CO.UK SITE. IN NO EVENT SHALL FUNDS4SCHOOLS NOR ITS AFFILIATES BE LIABLE TO USERS FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND THAT MAY RESULT FROM THE USE OF OR THE INABILITY TO USE THE FUNDS4SCHOOLS PROGRAM OR FROM THE FAILURE TO MAKE REBATES TO THE DESIGNATED ENROLLED SCHOOLS, REGARDLESS OF WHETHER FUNDS4SCHOOLS OR ITS AFFILIATES WERE MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER SUCH DAMAGES ARISE IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE. USER AUTHORIZES FUNDS4SCHOOLS AND ITS AFFILIATES TO PERFORM ALL ACTIONS NECESSARY HEREUNDER, INCLUDING WITHOUT LIMITATION, THE DIRECTING OF REBATES TO AN ENROLLED SCHOOL DESIGNATED BY USER.

Intellectual Property
The trademarks, logos and services marks ("Marks") displayed on the Funds4Schools.co.uk Site are the property of Funds4Schools and other parties. Users are prohibited from using any Marks for any purpose without the written permission of Funds4Schools or such third party which may own the Marks. All information and content including any software programs available on or through the Funds4Schools.co.uk Site ("Content") is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Funds4Schools.co.uk Site for commercial or public purposes.

Merchant Policy
Users who buy products or services from Merchants will be deemed to be customers of Merchant. All rules, policies (including privacy policies) and operating procedures of Merchant will apply to Users while on such Merchant's site or local store location. Funds4Schools is not responsible for information provided by Users to Merchants. Merchant and Funds4Schools are independent contractors and neither party has authority to make any representations or commitments on behalf of the other.

Links to Other Sites
Access to any other Internet web site linked to the Funds4Schools.co.uk Site is at the User's own risk. User should be aware that linked web sites may contain rules and regulations, privacy provisions, confidentiality provisions, transmission of personal data provisions, and other provisions that differ from the provisions provided on the Funds4Schools.co.uk Site. Funds4Schools is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions.

Disputes / Errors
All questions or disputes regarding the Program, including without limitation, questions or disputes regarding eligibility for the Program, or the eligibility of rebates for accrual or redemption, must be submitted in writing within 60 days of the qualifying transaction, to Funds4Schools, The Old Forge, 3 Packman Lane, Kirk Ella, Hull, HU10 7TH. Any such disputes shall be resolved by the Funds4Schools at its sole discretion. All interpretations of Program Terms and Conditions shall be at the sole discretion of the Funds4Schools. In the event that an error is made by the Funds4Schools, your sole remedy shall be the credit of the disputed rebate to the Designated Enrolled School.

MISCELLANEOUS
This Agreement will be governed by and construed in all respects in accordance with English law. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture or agency relationship between Funds4Schools and the Affiliated Merchants or between the Funds4Schools and any other of its Corporate Partners. Neither the Affiliated Merchants nor any Corporate Partner shall have the ability to create any obligation on the Funds4Schools's behalf. This Agreement constitutes the entire agreement between you and the Funds4Schools with respect to the Program.
